Avandia Hit With Another Wrongful Death Suit

On Monday of this week the family of now deceased Milagros Larosa, 65, filed a wrongful death lawsuit against GlaxoSmithKline, the makers of the once blockbuster Avandia. The lawsuit alleges that GlaxoSmithKline liable for the death of Larosa due to their negligence, fraud, breach of warranty, and a their failure to adequately warn about the risks associated with Avandia.

Over the last year of Larosa's life she was hospitalized on three separate occasions for ischemic events and ultimately she suffered a fatal stroke. The lawsuit claims that Larosa had suffered no prior heart problems before taking Avandia.

This is one of several wrongful death lawsuits filed in regards to Avandia over the past several months. In May an article published in the New England Journal of Medicine suggested that Avandia could be linked to a 42 percent increased risk of heart attack. The drug has also been link to this peril by another study released just a couple of weeks ago.

The FDA has issued two black box warnings for the drug over the past few months to warn of a risk of heart failure and the possible increased risk of heart attack. A panel of outside experts recommended keeping the drug on the market but advised the FDA to include the black box warnings.

The events suffered by Larosa fall directly inline with the potential risks warned of by the FDA and suggested by recent studies. The FDA continues to further evaluate Avandia and over the next year GlaxoSmithKline could be in for a real battle concerning this drug.
